The cost of the registration is low and it's a simple payment as any service. Who registers domestic work is not an employer but somebody who gives an employment. And the difference is not only semantic.
The Ministry of Work, Employment and Social Security will run a campaign until Saturday 7 for diffusion, education and awareness on the obligation of “work givers” to register domestic workers.
The regional director of the Ministry of Work, Roberto Deb, and the head of the delegation Santa Fe, Oscar Bianchini, explained that in the case of domestic work it would be correct not to speak of employers, but of work givers.
“The difference is important: the registration of domestic work does not fall in the Contracted Work Regime, but corresponds to another special regime, which was armed to facilitate the possibility of the registration. Many aspects are avoided which mean to whiten an employee under the Contracted Work Regime”, they indicated.
“It is not a semantic problem. In fact, the figure of who engages domestic service is the `work giver' not the `employer', because he is somebody who is not registered as an employer', they emphasized.
They remembered that the only condition which is demanded for the proceeding is that the domestic worker has his number of Cuil, the foreigners with simple leave authorized by Migrations even can be newly recruited.
To speak of work giver, and not of employer, includes the voucher for the payment of the registration. “The signature of an employer is not requested”, they emphasized.
In a stand that settled in one of the great supermarkets, located in the harbor zone of our city, the previous days and during the long weekend, the ministry will try to explain to those who count on domestic service how many advantages the registration grants, for both parts. And, mainly, how many headaches those who count on regular papers can get rid of, before any eventuality.
The campaign will extend until April 7. Its motto will be “We focus on domestic work”.
Those interested will be able to inquire on the benefits of the registration of particular domestic workers, on the simple proceeding for the inscription, on the rights which the worker enjoys, on the cover which grants the regime to both parts, and on the tax deductions on the payments and contributions, which will be up to 12,000 pesos annually.
In addition, those who approach the stand and employ domestic workers will be remembered to fulfill the registration. And that this obligation does not depend on the will of the domestic worker.
Often the idea that domestic workers do not want to be registered works as excuse. In fact, for the donees of the registration there are only benefits and no type of disadvantage.
“We are going to look for the work givers, to try to finish with the idea that registering the domestic personnel implies to assume a work contract. That is not the case. With the registration of domestic work a different relation settles down, whose cost frankly is low”, they assured.
They remembered that “the risks that people have who count on domestic personnel without registering are high. By demands, by accidents that could happen, by a series of things. And however the benefits are important, and for both parts”, they indicated.
For domestic workers the new recruitment implies to have access to a retirement regime and to social security if a certain contribution is completed: at the moment 95 pesos. There are three scales, for those who work from 6 to 12 hours weekly; from 12 to 16; and more than 16.
Who acquires the universal child allowance and is newly registered will in no case lose that benefit.
For the officials of the Ministry of Work it is doubtless that the existence of a special registration regime, different from the Contracted Work Regime, has created better conditions to promote domestic work.
“Habitually, a housewife is not accustomed to employ people; what we want to indicate to them is that having domestic personnel while not fulfilling the registration assumes an unnecessary risk; by means of campaigns like this we hope to create awareness on the important benefits that can be obtained for the domestic workers when being registered, for a low payment”, they emphasized.
In the same way, after remembering that it will be possible to claim tax relief on gains up to 12,000 pesos, the officials of the Ministry of Work maintained that “they hope for more” accountants, that is to say, those who give their knowledge and advice to those who have high income and thus high taxes to pay.
“We frequently meet with Schools of Accountants to stimulate this. Surely the professionals are more led by taxpayers' aspects, than by labor aspects. And maybe they forget this detail, to claim tax relief up to 12,000 pesos per year”, they added.
